FoodState® “Win a year’s supply of supplements” Competition

  1. The FoodState® “Win a year’s supply of supplements” Competition (“the Competition”) will be run by Regal Nutrients (Proprietary) Limited (“Regal Nutrients”) in South Africa from 1 March 2010 to 28 February 2011 (inclusive).
  2. A participant will enter the Competition by sending a short message service (“SMS”), indicating the FoodState® barcode of a purchased FoodState®, to the number 38645.  Each SMS will be charged at a rate of R1.
  3. Upon sending the SMS, the participant will receive an automated response: “Thank you for entering the FoodState® “Win a year’s supply of supplements” competition.  Visit www.whynaturalisbetter.co.za for more information”.
  4. Participants may enter the Competition as many times as they wish.
  5. The Competition is open to all South African residents, excluding the directors, members, partners, employees or agents of, or consultants to Regal Nutrients, its advertising agencies, suppliers, controlling or their immediate family, life partners, business partners or associates.
  6. Within the first week of the following month, for the duration of the Competition, a competition winner shall be randomly drawn by the management of Regal Nutrients from all entries received during that month, i.e. from the 1st of that month to midnight on the last day of that month.
  7. The winner of each monthly draw shall receive a 12 month’s supply (using the recommended dosage) of a single product (“Prize”) for of one of the FoodState® products as mutually agreed between the winner and Regal Nutrients management.  The Prize is not negotiable or transferable and may not be exchanged for cash. Each monthly draw is exclusive to that month, and there is no roll-over of entries into succeeding months.
  8. The winner of each monthly draw shall be notified by Regal Nutrients via sms to the number used to submit the original entry and, upon Regal Nutrients receiving notification of the winner’s preferred delivery address, which delivery address is restricted to an address within the borders of South Africa, Regal Nutrients shall send the Prize to the winner at the address provided to Regal Nutrients.  Should the winner wish to collect their prize, then their Prize may be collected from Regal Nutrients Head Office, situated at Sportron House, 2 Eaton Avenue, Bryanston, provided that 48 hrs prior notice of such collection is given to Regal Nutrients by the winner contacting them at (011) 317-8550 to make the necessary arrangements.
  9. In the event that Regal Nutrients does not receive notification of the address of the winner within 30 (thirty) days of having informed the winner that he or she has won a Prize, the winner shall be deemed to have forfeited the Prize to Regal Nutrients and shall have no claim against Regal Nutrients arising therefrom.
  10. 10.  Regal Nutrients, its directors, officers, servants, contractors, sub-contractors or agents (“the Competition Organisers”) shall not be held liable (whether in contract or delict) in any way whatsoever for any loss or damage (including consequential or special damages) of whatsoever nature and whether or not caused by the negligence of the Competition Organisers, their directors, servants, officers, agents or any other persons acting on behalf of the Competition Organisers, which may be caused to or suffered or sustained by any participant or winner of the Competition, its agents, customers, invitees, licensees or any other third party arising out of, incidental to or connected in any way with the Competition.
  11. 11.  Any personal information relating to a participant that was collected by Regal Nutrients during the Competition will not be shared with any third party without the participant’s express written consent.
  12. 12.  Regal Nutrients reserves the right to reduce the duration of, extend, modify or cancel the Competition.
